Partner Agreement
The rules that keep the program generous, trusted, and compliant. Read them once; they protect you.
1. The relationship
You are an independent contractor promoting Trait (operated by Vitality, Inc.) in exchange for commissions. This is not employment, partnership, or agency. You have no authority to bind or make representations on behalf of Trait beyond what is expressly approved here.
2. FTC disclosure (required, every time)
Under the FTC Endorsement Guides (16 CFR Part 255), you must clearly and conspicuously disclose that you earn a commission on every piece of content that includes your link or code. The disclosure must be in the same medium as the endorsement, unavoidable, and near the claim or link (e.g. "#ad" or "I earn a commission from Trait" — not buried in a bio or behind a "more" tap). We provide approved disclosure language; using it is mandatory.
3. Wellness only — prohibited claims
Trait is a dietary-supplement wellness brand, not a medical or diagnostic one. You may share wellness and nutrition benefits only. You may NOT claim or imply that Trait or any product diagnoses, treats, cures, prevents, or mitigates any disease or condition; that the DNA analysis is a medical, clinical, or diagnostic test; or that it predicts disease. You may not say "FDA-approved." Only use claims Trait has pre-approved in writing. These rules protect you as much as us.
4. Genetic-privacy representations
You may not collect, store, or handle any customer's genetic data, and you may not make any representation about how Trait handles genetic data beyond Trait's published Privacy Policy. Do not imply Trait shares or sells DNA data.
5. No fabrication; approved assets only
No fake reviews, invented testimonials, or unsubstantiated results. Use only the creative, imagery, and language Trait provides or approves. Do not bid on Trait trademarks or branded keywords in paid search, use typosquatting/cookie-stuffing, or promote via spam (you must comply with CAN-SPAM).
6. Commissions
Standard tier: $30 per DNA kit purchased through your link or code, plus 10% of every subscription payment a referred member makes, for the life of their membership. Partner tier (by invitation): $40 per kit and 15% recurring. Recurring commission is earned only on successfully collected monthly payments and stops when the member cancels. Attribution is 30-day, last-click on the kit; the subscription is credited to that member's original referrer. Commissions accrue as pending, clear a validation window, and become payable once approved. We may reverse (claw back) commissions on refunds, chargebacks, or violations of these terms, and may adjust the commission structure prospectively.
7. Payouts & tax
You must provide a valid payout method and a completed W-9 (US) or W-8BEN/W-8BEN-E (non-US) before we can pay you. We issue a Form 1099 where required. A minimum balance may apply before payout. You are responsible for your own taxes.
8. Monitoring, suspension & termination
We may review your content for compliance and may withhold commissions, suspend, or terminate your account for any violation of these terms, with or without notice for serious or repeated violations. Either party may end this relationship at any time; commissions properly earned before termination and not subject to clawback will still be paid.
9. Changes
We may update these terms and the commission structure prospectively. Material changes will be communicated, and continued participation constitutes acceptance.
This is the operating summary of the program. Vitality, Inc. may provide a full executed agreement for partner-tier participants.
